Terms & Conditions
Last updated: 14 April 2025 · Effective date: 14 April 2025
Please read these terms before using the Bumi Advocates website or instructing the firm. By using the website or instructing us, you agree to be bound by these terms. If you do not agree, please do not use the website or instruct us.
1. Definitions
In these terms:
- "the firm", "we", "us" means Bumi Advocates, a law practice in Singapore.
- "client" or "you" means a person who instructs the firm or uses the website.
- "services" means the legal services described on this website and in individual cost agreements.
- "website" means the pages accessible at this domain and its subpages.
- "matter" means a specific legal instruction accepted by the firm.
2. Acceptance of Terms
These terms apply to your use of the website and to any instructions you place with the firm. By submitting an enquiry, entering into a cost agreement, or continuing to use the website after the date of any revision to these terms, you accept the terms as they stand at that time.
Our services are intended for adults. By instructing the firm, you confirm that you are at least eighteen years of age and have the legal capacity to enter into an agreement.
3. Services
Bumi Advocates provides legal services in three areas: Pension Stratum Review, Recalculation Representation, and Long Settlement Planning. A description of each service, including its scope and fee, is set out on the Solutions page of this website and in the cost agreement provided to each client before work begins.
The firm does not hold itself out as capable of advising on all aspects of pension or estate law. Where a matter falls outside our areas of practice, we will tell you and, where possible, suggest an alternative course.
The firm is regulated under the Legal Profession Act (Singapore) and all solicitors hold current practising certificates issued by the Law Society of Singapore.
4. Client Relationship and Instructions
A solicitor-client relationship is formed only when the firm issues a cost agreement and the client accepts it. An initial enquiry or consultation does not create a client relationship.
You are responsible for providing accurate and complete information relevant to your matter. We will rely on the information you provide and cannot be responsible for conclusions based on information that is incorrect or incomplete.
5. Fees and Payment
Fees are set out in the written cost agreement provided before any work begins. For fixed-fee services (Pension Stratum Review at SGD 200 and Long Settlement Planning at SGD 350), the fee applies to the scope of work described in the agreement. For Recalculation Representation (from SGD 495), fees are reviewed and agreed at each significant stage of the matter.
Fees are payable in Singapore dollars. Payment terms are as specified in the cost agreement. The firm does not commence work until the cost agreement has been executed and any required deposit received.
Refund Policy
If you wish to terminate your instruction before the relevant service is complete, fees for work already carried out will be retained. Where the fee is fixed and the matter has not yet commenced, the firm will consider a refund request on its particular circumstances. Any refund decisions are made by the firm at its discretion in accordance with the Law Society of Singapore's guidelines on professional fees.
6. Confidentiality
All information provided to the firm in connection with your matter is held in confidence, consistent with our professional obligations under the Legal Profession (Professional Conduct) Rules. We do not disclose client information except as set out in our Privacy Policy or as required by law or a court order.
7. Intellectual Property
The content of this website — including text, layout, and structural organisation — belongs to Bumi Advocates. You may view and print pages for your own private use. You may not reproduce, adapt, or redistribute any content without our written permission.
Written reports and documents prepared for you in the course of your matter are provided for your personal use in connection with that matter. They are not to be shared with, or relied upon by, third parties without the firm's prior written consent.
8. Disclaimers
The information on this website is provided for general informational purposes only. It does not constitute legal advice and does not create a solicitor-client relationship. You should not act on the basis of website content alone — please contact us directly for advice relevant to your situation.
The firm makes no representation that the services described on the website will produce any particular outcome. Legal outcomes depend on facts and circumstances that cannot be assessed from a website alone.
9. Limitation of Liability
To the extent permitted by law, the firm's liability to a client arising from any matter is limited to the fee paid by that client in respect of that matter. The firm is not liable for indirect, consequential, or special losses.
Nothing in these terms limits the firm's liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded under Singapore law.
10. Indemnification
You agree to indemnify the firm against any claim, loss, or liability arising from your use of our services where that claim, loss, or liability results from information you provided to us that was incorrect, misleading, or incomplete.
11. Termination
Either party may terminate the solicitor-client relationship by written notice. The firm may decline to continue a matter if there is a conflict of interest, if the client's instructions require conduct inconsistent with our professional obligations, or in other circumstances recognised by the Law Society guidelines.
On termination, the client remains liable for fees in respect of work already carried out. The firm will return the client's documents promptly after any outstanding fees are settled.
12. Governing Law and Dispute Resolution
These terms are governed by the laws of Singapore. Any dispute arising from these terms or from a client matter is subject to the exclusive jurisdiction of the Singapore courts.
Before initiating formal proceedings, we ask clients to raise concerns with us directly. We will attempt to resolve any complaint in good faith. Where that is not possible, the Law Society of Singapore provides a complaints process for matters concerning professional conduct.
13. General
If any provision of these terms is found to be unenforceable, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full effect. The firm's failure to enforce any provision does not constitute a waiver of the right to enforce it later.
14. Changes to These Terms
We may revise these terms from time to time. The revised version will be posted on this page with an updated "last updated" date. The terms applicable to a matter in progress are those in force at the date the cost agreement was issued for that matter.
